***** ARCHANA PURI, J. (Oral) As per the observations made in the order dated 28.11.2025, despite service, the respondent did not make appearance on that date. Even today, he has not made appearance. As such, the respondent is proceeded against ex parte.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. DMC/25/2024, titled 'Arun Kumar Vs. Neetu', filed by the respondenthusband, pending in the Family Court (Camp Court) Tosham, District Bhiwani and she seeks transfer of the same to the Court of competent jurisdiction at Charkhi Dadri.
It is submitted by the counsel for the applicant that there is a matrimonial dispute between the parties. One son born from the wedlock of the parties, who is about 4 years old, is in the care and custody of the applicant. Also, it is submitted that the applicant is not having any source of earning and as such, she is dependent upon her parental family. Even, she has filed the petition under Section 125 Cr.P.C., which is pending in the Courts at Charkhi Dadri and the respondent is pursuing the same. Besides the same, the applicant has also got lodged an FIR bearing No.70 dated 19.07.2024, under Sections 313, 323, 34, 498-A and 506 IPC, which is under investigation. The distance between the two places is stated to be about 50 kms. on one side.
In view of the submissions aforesaid, more particularly, considering the fact of the applicant not having any source of earning and taking care of 4 years old son; fact of other litigation arising from the matrimonial dispute, already pending in the Courts at Charkhi Dadri and above it, considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. DMC/25/2024, titled 'Arun Kumar Vs. Neetu', filed by the respondent-husband, stands transferred from the Family Court (Camp Court) Tosham, District Bhiwani, to the Court of competent jurisdiction at Charkhi Dadri. The requisite record of the aforesaid case be sent by the Family Court (Camp Court) Tosham, to the District and Sessions Judge, Charkhi Dadri.
Learned District and Sessions Judge, Charkhi Dadri, shall assign the said petition to the Family Court, Charkhi Dadri. Even, the parties are directed to appear before the Family Court, Charkhi Dadri, within a period of one month from today onwards.
