(Oral) At this stage, counsel for the respondent has given a statement that the respondent has no objection, if the transfer application is accepted and the guardianship petition is transferred. The applicant-mother has filed the present application for seeking transfer of the petition under Section 25 of the Guardians and Wards Act i.e. GW/53/2023, titled 'Baljit Singh Vs. Kulbir Kaur', filed by the respondent-father (husband of the applicant), pending in the Family Court, Patiala and she seeks transfer of the same to the Court of competent jurisdiction at SAS Nagar.

It is evident from the contents of the application that the subject child is residing with the applicant at Kharar. The applicant is allegedly unemployed and as such, is having no source of earning. Furthermore, the petition under Section 12 of the Protection of Women from Domestic Sonu 2025.09.05 15:34 I agree to specified portions of this document P&HHC

TA-1483-2023 (O&M) Violence Act, filed by the applicant is pending in the Courts at Kharar and the respondent is making appearance in the same. Though, the applicant is seeking transfer of the guardianship petition at SAS Nagar, but however, the other litigation, as observed aforesaid, is pending at Kharar. Even, the subject child is residing at Kharar.

In view of the contents of the application, as well as keeping in view the statement given by the counsel for the respondent, the transfer application is allowed, and the petition under Section 25 of the Guardians and Wards Act i.e. GW/53/2023, titled 'Baljit Singh Vs. Kulbir Kaur', filed by the respondent-father (husband of the applicant), stands transferred from the Family Court, Patiala, to the Court of competent jurisdiction at Kharar, District SAS Nagar. The requisite record of the aforesaid case be sent by the Family Court, Patiala, to the District and Sessions Judge, SAS Nagar. Learned District and Sessions Judge, SAS Nagar, shall assign the said petition to the Family Court (Camp Court) Kharar. Even, the parties are directed to appear before the Family Court (Camp Court) Kharar, within a period of one month from today onwards.
