This contempt petition has been filed alleging non-compliance of order passed by the Court dated 23.03.2023. 2.
It appears that after the order was passed, the respondents have issued an order on 21.07.2023. However, learned counsel for the petitioner submits that the respondents have changed seniority position of the petitioner and although no recovery has been made but the date of promotion given earlier, has been changed.

I have heard learned counsel.

Once the order has been passed by the respondents after taking into consideration the order of this Court, it cannot be said that there is deliberate and willful disobedience.

The contempt petition is accordingly dismissed. However, if the petitioner is still aggrieved, he can always file a fresh writ petition or initiate appropriate proceedings before appropriate Court, assailing the said order. (SANJEEV PRAKASH SHARMA) JUDGE 15.11.2023.
