The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking refixation of pay in view of judgment of Supreme Court in State of Punjab vs. Jagjit Singh and others, 2017(1) SCC 148.

The petitioner is claiming that he joined respondent on 23.10.1985 as daily wager. He was regularized on 18.05.2005. He was not paid salary equal to minimum of regular pay scale during 1985 to 2005.

Ms. Kiranjeet Kaur, Advocate submits that in view of judgment of Supreme Court in Jagjit Singh's case (supra), the petitioner was entitled to pay equal to minimum of regular pay scale. Anju Goel 2024.11.13 10:04 I attest to the accuracy and integrity of this document Chandigarh

Mr. Dhir submits that the petitioner has approached this Court after 19 years from the date of cause of action, if any. A Co-ordinate Bench of this Court vide order dated 13.04.2023 has dismissed a bunch of petitions including CWP No.25984 of 2015 titled as "Rajinder Pal and others vs. State of Punjab and another" on the ground of delay. In the said case, similar claim was made after 12 years. 4.

On being confronted with aforesaid judgment, Ms. Kiranjeet Kaur expressed her inability to controvert applicability of aforesaid judgment to facts of the present case.

By order dated 13.04.2023, this Court has dismissed a bunch of writ petitions on the ground of delay wherein a similar claim was made.
