**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 81 dated 15.8.2018 under Sections 409, 120-B IPC registered at Police Station Kotwali, Nabha, District Patiala.

Mr. Parminder Singh-I, Advocate has put in appearance on behalf of the complainant and filed his power of attorney which is taken on record.

Learned counsel for the petitioner submits that the petitioner is running private computer centre and has no role to play in the alleged offence as per present FIR and similarly situated co-accused Karnail Singh Cashier with the Electricity Department has been granted regular bail vide order dated 18.11.2019. He further submits that the allegation against the petitioner is that it was the petitioner who, during interrogation, has revealed that the bills amounting to the tune of Rs. 55.00-60.00 lacs has been used for the construction of the house whereas while granting regular GURPREET SINGH 2020.01.29 10:54 I attest to the accuracy and authenticity of this document chandigarh

CRM-M No. 51517 of 2019 -2bail to Karnail Singh only factor taken into consideration is that he has no knowledge how to operate the computer. Learned counsel also submits that the petitioner has been in custody since 16.10.2019. Learned State counsel, on instructions from ASI Jai Parkash, submits that in the present case charges are yet to be framed. The petitioner has been in custody since 16.10.2019. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
