The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.310 dated 11.7.2019 at Police Station Butana, District Karnal under Sections 148, 149, 323, 324, 341 and 506 of Indian Penal Code, wherein offence under Section 326 IPC was added lateron.

While granting interim bail to the petitioner on 14.1.2020, the following order was passed:

"Through this petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to the petitioner in case FIR No.310 dated 11.07.2019, registered under Sections 148, 149, 323, PANKAJ KAKKAR 2022.01.11 17:23 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-51510-2019 (O&M) 324, 341, 506 IPC (Section 326 IPC added lateron), at Police Station Butana, District Karnal.

According to prosecution, on 10.07.2019, petitioner alongwith his 8-10 accomplice caused injuries to complainant with their respective weapons. The petitioner was having a stick (danda). Heard.

The petitioner is directed to join the investigation and would come present as and when called for and in the event of arrest, the petitioner shall be admitted to interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting/Investigating Officer. The petitioner shall also abide by the conditions as specified under Section 438 (2) Cr.P.C. Adjourned to 08.05.2020, for consideration."

Learned State counsel, upon instructions, has submitted that the petitioner pursuant to interim directions, has already joined investigation and is not required for any custodial interrogation. It has also been informed that apart from the present case, the petitioner happens to be involved in one more case under Sections 354, 365, 452 and 506 of Indian Penal Code. 4.

Having regard to the aforesaid position, wherein the petitioner is stated to have joined investigation and is not required for any custodial interrogation, the petition is accepted and the interim directions issued by this Court vide order dated 14.1.2020 are hereby made absolute, subject to the condition that the petitioner shall join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438(2) Cr.P.C. 11.1.2022 ( Gurvinder Singh Gill ) pankaj Judge Whether speaking /reasoned Yes / No Whether Reportable Yes / No PANKAJ KAKKAR 2022.01.11 17:23 I attest to the accuracy and integrity of this document
