The substantive prayer made in the petition reads thus: 'It is, therefore, most respectfully prayed before this Hon'ble Court that the petition of the petitioner be allowed and the petitioner be released on Interim Regular Bail in case FIR No. 29 dated 20.03.2025 (Annexure P-1) U/s 109(1), 3(5) of BNS 2023 and u/s 25 and 27 Arms Act 1959 and 21(C), 29 of NDPS Act Added Later on registered at Police Station Jaito, District Faridkot, Punjab on account of death of the mother of the petitioner on 01.09.2025, in the interest of justice.'

Learned counsel for the petitioner has argued that the petitioner has preferred an application before the concerned Special Judge/Sessions Court at Faridkot for grant of relief, as sought for in the instant petition, but the same has yet not been decided as the learned Presiding Officer has not been holding the Court.

CRM-M No.51186 of 2025 -23. Without delving into the issue that the petitioner ought to have pressed the prayer before the Vacation Judge/Duty Judge at Faridkot & keeping in view the factum of the Bhog ceremony of the deceased mother of the petitioner being slated for tomorrow i.e., 11.9.2025, this Court deems it appropriate to direct the concerned Jail Superintendent to have the petitioner taken to attend the Bhog ceremony of his deceased mother slated to be fixed for tomorrow i.e., 11.9.2025 from 9:00 a.m. to 4:00 p.m. in police escort. The Senior Superintendent of Police, Faridkot is directed to provide requisite police support/escort to the Jail Superintendent for carrying out this order. It is further directed that the direction is being passed, for the nonce, keeping in view that the Bhog ceremony of the deceased mother of the petitioner is slated for tomorrow i.e., 11.9.2025. 4.

Needless to say that the petitioner shall be at liberty to press for his pending application before the learned Special Judge, in accordance with law for remaining relief, if any.
