The prayer in the present petition under Section 482 Cr.P.C., 2023 is for quashing of the FIR No.236 dated 07.12.2011 under Sections 279, 304-A, 427 IPC and to quash the order dated 11.07.2025, whereby the petitioner has been declared a proclaimed person. 2.

On 20.02.2026, the following order was passed:- "The prayer in the present petition under Section 482 Cr.P.C. is for quashing of the FIR No.236 dated 07.12.2011 registered under Sections 279, 304-A, 427 IPC at Police Station Samrala Police District Khanna, District Ludhiana and the order dated 11.07.2015 (Annexure P-9) whereby the petitioner has been declared a proclaimed person on the grounds that a compromise has been arrived at between the parties.

The learned counsel for the petitioner at the very outset states that he does not wish to seek quashing of the FIR on the basis of a compromise as the offence is under Section 304A IPC but prays that the order dated 11.07.2015 (Annexure P-9) whereby the petitioner was KUSUM 2026.04.23 19:35 I attest to the accuracy and integrity of this document PHHC Chandigarh

Adjourned to 23.04.2026.

Subject to a deposit of Rs.2,00,000/- as costs with the Sadhna Society for the Mentally Handicapped, Near Housing Board Chowk, Raen Basera Building, Manimajra, Sector 13, Chandigarh, the operation of the order dated 11.07.2015 (Annexure P-9) shall remain stayed. The petitioner is directed to surrender within a period of 03 weeks and seek bail which shall be decided on its own merits. Needless to say if the petitioner does not comply with this order, the present petition will be deemed to have been dismissed."

Despite passing of the aforementioned order, the petitioner has not returned back to join proceedings. Further, an FIR registered under Section 304-A in any case cannot be quashed on the basis of a compromise.

In view of the above, I find no merit in the present petition and the same stands dismissed.

All the pending miscellaneous applications, if any, stand disposed of.
