The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondents to take appropriate action against Khushal Fuels, Kaithal Road, Cheeka (in short "the dealer"). 2.

The grievance of the petitioner is that Indian Oil Corporation Limited (in short "Corporation") has entered into dealership agreement dated 23.09.2010 (Annexure P-7) with the dealer who has further entered into subdealership with the petitioner. As per Clause 35 of the dealership agreement, a dealer of Corporation cannot enter into sub-dealership, thus, the dealer has violated Clause 35 of dealership agreement. The petitioner has made complaint to Corporation, however, Corporation is not paying heed to the complaint of the petitioner.

Mr. Ashish Kapoor, Advocate for Corporation, who on advance notice is present in Court, submits that petitioner has filed civil suit against Corporation as well as dealer. The Corporation, on receipt of summons from civil court, issued notice to the dealer. The dealer has already filed reply to the notice. The Corporation is going to pass an appropriate order, in accordance with law.

In the wake of statement of learned counsel for Corporation, the petition stands disposed of.
