   against impugned order dated 28.08.2025 passed by Additional Sessions Judge, Fatehabad, vide which his anticipatory bail application in FIR No.173 dated 24.07.2025, under Sections 109(1), 3(5), 238 BNS, 25/54/59 of Arms Act, 3 of SC and ST Act, registered at Police Station City Ratia, District Fatehabad, has been dismissed        

 

"Appellant has filed appeal against impugned order dated 28.08.2025 passed by Additional Sessions Judge, Fatehabad, vide which his anticipatory bail application in FIR No.173 dated 24.07.2025, under Sections 109(1), 3(5), 238 BNS, 25/54/59 of Arms Act, 3 of SC and ST Act, registered at Police Station City Ratia, District Fatehabad, has been dismissed.

Learned counsel for the appellant contended that initially appellant was not named in the FIR but his name surfaced later on, on the basis of disclosure statement of co-accused Ramandeep Singh @ Namu. He has further contended that no specific role or injury has been attributed to the appellant. Firearm injuries are attributed to the co-accused - Vishnu @ Dogar. The provisions of SC and ST Act are not attracted qua the appellant as appellant himself belongs to SC category and in this context he has referred to Annexure P-2. As per SC certificate of the appellant, he belongs to SC category. He has submitted that nothing is to be recovered from appellant and the appellant is ready and willing to join investigation. Meanwhile, the appellant shall join the investigation and would come present as and when called for and in the event of arrest, the appellant shall be released on interim bail on his furnishing personal and surety bonds to the satisfaction of Arresting/ Investigating Officer.
