(Oral) (1) Learned counsel for the appellant submits that certain documents which would have a huge impact on the outcome of the appellant's petition could not, by sheer inadvertence, be brought to the notice of the learned Single Judge and therefore, the appellant be permitted to withdraw the instant appeal to enable him to move the learned Single Judge through filing of an appropriate application seeking therein review/recalling of the judgment impugned through the instant appeal. (2) Dismissed as withdrawn with liberty as prayed for. (3) It is clarified that in case the review application, the liberty for which has been sought and got through the instant order, is filed and is rejected by the learned Single Judge, it shall not preclude the appellants to challenge the impugned judgment and such rejection, in accordance with law.
