  2) '( ' * 3       45 6The present petition has been filed under Section 482 of BNSS, 2023, for grant of anticipatory bail to the petitioner in case FIR No.09 dated 19.01.2025, registered at Police Station Arniwala, District Fazilka, under Sections 351(2), 126(2), 115(2), 191(3), 190 of BNS, and later on Sections 109, 117(2) and 238 of BNS.

Learned counsel contends that the petitioner has been attributed a kappa blow though on the head, however, the same has not been declared as dangerous to life, while it is a case of version and cross-version and there is a DDR, Annexure P-2, recorded on the statement of co-accused, Anmol. There is a delay of six days in the registration of the FIR. Co-accused, Kuldeep Singh has since been enlarged on bail, vide order dated 22.08.2025, Annexure P-3. The petitioner has been falsely implicated in the present case only on account of there being a dispute between the family of coaccused, Anmol with the complainant. The aforesaid person, who has been attributed the injury declared dangerous to life, stands arrested, alongwith one Hardeep Singh. The petitioner is ready and willing to join the investigation as and when required by the investigating agency and will cooperate. Notice of motion.

Meanwhile, the petitioner is directed to join the investigation on or before 22.09.2025. In the event of his arrest, he shall be released on interim bail to the satisfaction of the Arresting Officer, subject to compliance of conditions as enshrined under Section 482(2) of BNSS, 2023. However, it is clarified that if the petitioner does not join and cooperate with the Investigating Agency as required by the Arresting/Investigating Officer, this interim order shall be deemed to have been vacated.
