Mr. Vishnu Dutt, Advocate for Mr. Naveen Bawa, Advocate for the appellants. **** DEEPAK SIBAL , J.(ORAL) (1) Learned counsel for the appellants contends that the appellants' prayer before the learned Single Judge was for the grant of compensation and though this issue was argued before the learned Single Judge no finding on the same has been returned. Therefore, the appellants be permitted to withdraw the present appeal to enable them to move the learned Single Judge through filing of an appropriate application seeking therein review/modification of the judgment impugned through the instant appeal. (2) Dismissed as withdrawn with liberty as prayed for.
(3) It is clarified that in case the review application, the liberty for which has been sought and got through the instant order, is filed and is rejected by the learned Single Judge, it shall not preclude the appellants to challenge the impugned judgment and such rejection, in accordance with law.
