This petition under Section(s) 482 Bharatiya Nagarik Suraksha Sanhita, 2023, has been moved for grant of anticipatory bail with regard to a case arising out of FIR No. 53 dated 16.08.2025 for the commission of offence punishable under Section(s) 125 of the Bharatiya Nyaya Sanhita, 2023/the Indian Penal Code, 1860 and Section(s) 25 and 27 of the Arms Act, 1959, Police Station Airport Amritsar, District Amritsar, Punjab. 2.

Vide order dated 12.09.2025 the petitioner was admitted to interim anticipatory bail, subject to the condition of furnishing bail/surety bonds to the satisfaction of Investigating/Arresting Officer. 3.

It has been submitted by learned counsel for the petitioner that in compliance with the above-mentioned order, the petitioner has already joined investigation and therefore, the order dated 12.09.2025 be made DEEPAK KUMAR BHARDWAJ 2026.02.21 21:02 I attest to the accuracy and integrity of this document

In response to the above-mentioned contention, the learned State Counsel has submitted that although the petitioner has joined investigation and the weapon has been seized by the Investigating Officer, but the license of weapon has not been handed over by the petitioner to the Investigating Officer.

In view of the fact that the license of weapon can be procured by the Investigating Officer from the office of District Magistrate, it is hereby observed that for the abovesaid purpose no ground for custodial interrogation of the petitioner is made out. Hence it is hereby held that the petitioner is not required for custodial interrogation. 7.

In view of the above-mentioned observation, the present petition is hereby allowed and the order dated 12.09.2025, whereby interim anticipatory bail was accorded to the petitioner, is hereby made absolute. (Surya Partap Singh) Judge February 19, 2026 "DK"
