The petitioner seeks grant of anticipatory bail in respect of a case registered against him vide FIR No.33 dated 18.9.2022 under Sections 7, 7-A and 13 of Prevention of Corruption Act, 1988 and Section 120-B and 180 IPC, 1860, Police Station Vigilance Bureau, District Karnal.

On the last date i.e. 22.12.2022 the following order was passed: "This petition is filed seeking anticipatory bail in case of FIR No. 33 dated 18.9.2022 under Sections 7, 7-A and 13 of Prevention of Corruption Act, 1988 and Section 120-B and 180 IPC, 1860 lodged at P.S. Vigilance Bureau, Karnal. Brief facts are that on complaint of Vinod Kumar a trap was laid. Vinod Kumar Gulati was apprehended red handed. The name of the petitioner surfaced in a disclosure statement. The petitioner joined the investigation and his statement under Section 164 Cr.P.C was recorded. - 2 - CRM-M-60043-2022 (O&M) Learned counsel for the petitioner submits that no recovery is to be made and the petitioner has already joined the investigation and gave statement under Section 164 Cr.P.C. He further submits that he is ready to join investigation and co-operate.

Learned State Counsel appearing on advance notice seeks time.

List on 20th January, 2023.

In the meantime, arrest of the petitioner shall remain stayed subject to joining investigation within one week from today."

At the very outset, learned State counsel has submitted that the petitioner has joined investigation and is not required for any custodial interrogation. It has also been informed that the petitioner is not wanted in any other case.

Having regard to the aforestated position wherein the petitioner has joined investigation and he is not stated to be required for any custodial interrogation, the petition is accepted and in the event of arrest, the petitioner be released on bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Arresting/Investigating Officer and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
