The present writ petition has been filed under Articles 226/227 of the Constitution of India praying for issuance of a writ in the nature of certiorari for quashing the impugned order dated 03.09.2024 (Annexure P4) whereby the order for cancellation of sale deed has been ordered by the appellate authority. Further praying for staying the operation of impugned order (Annexure P-4) during the pendency of present writ petition.
2.
On 09.04.2026, the following order was passed by this Court:- "1. As per the mediation report, the mediation proceedings did not fructify, as the petitioner failed to participate in the said proceedings.
2. Learned counsel for the petitioner seeks one further opportunity for mediation and undertakes that the petitioner shall positively appear before the Mediation and Conciliation Centre of this Court.
3. The request made by learned counsel for the petitioner is accepted, subject to the petitioner bringing a demand draft in the sum of ₹10,000/-, drawn in favour of the respondent No.1- Ajmer Kaur, to be handed over to her at the time of appearance in the mediation proceedings. The petitioner as well as respondent No.1 are directed to appear before the Mediation and Conciliation Centre of this Court on 17.04.2026 to explore the possibility of an amicable settlement.
4. Since advocate Ms. Monika Jalota was earlier appointed as the Mediator in the present case and is conversant with the facts thereof, the Secretary-cum-Director, Mediation and Conciliation Centre of this Court, is requested to re-appoint her as the Mediator for the ensuing mediation proceedings.
5. List on 21.05.2026 for awaiting the outcome of the mediation proceedings.
6. Interim order to continue till the next date of hearing."
3.
Learned counsel for respondent No.1 submits that during the pendency of the present proceedings, the parties have amicably resolved the disputes inter se and have entered into a settlement agreement before the Mediation Centre. It is further submitted that in view of the settlement so arrived at and the report of the learned Mediator dated 17.04.2026, the present petition may be disposed of in terms thereof. 4.
I have heard learned counsel for the parties and perused the report of the Mediator dated 17.04.2026 along with the settlement agreement. A perusal thereof reveals that the parties have voluntarily and amicably resolved all their disputes and differences through the process of mediation without any coercion or undue influence. Since the settlement appears to be lawful and has been arrived at with the free consent of the parties, no impediment survives for disposal of the present petition in terms thereof.
5.
Accordingly, the present petition is disposed of in terms of the settlement agreement dated 17.04.2026. The terms and conditions of the settlement agreement shall form an integral part of this order and the parties shall remain bound by the same and shall strictly adhere thereto in its letter and spirit.
