The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents No. 4 to 8 to allot paddy for Custom Milling Police for KMS 2023-24. 2.

Learned counsel for the petitioner inter alia contends that petitioner was allotted paddy during last five years, however, all of sudden, despite accepting documents, the respondents have not allotted paddy. There is no fault on the part of petitioner, nevertheless, it has been denied paddy which entails depriving from right of business and trade. The petitioner has engaged labour and made every arrangement to carry out job work. The nonallotment of paddy is going to cause irreparable loss to the petitioner. The other rice millers are ready to part with paddy which they have received from HAFED subject to permission from HAFED.

Learned counsel for the respondents submits that as per Custom Milling Policy for KMS 2023-24, there is no provision to permit transfer of paddy from one job worker to another job worker, however, if this Court directs, competent authority would look into the matter and do the needful. 4.

In the peculiar facts and circumstances of the case, the respondents are directed to look into the request of the petitioner. To ensure safe delivery of the resultant product i.e. rice, the HAFED may seek security from original allottee as well as petitioner. 5.
