(Oral) This petition has been filed, inter alia, seeking a writ of certiorari quashing the impugned order dated 31.10.2023 endorsed on 06.11.2023, Annexure P-2, passed by respondent No.1. 2.

Learned counsel contends that as per terms of petitioner's appointment reflected in the order dated 28.08.2023, Annexure P-1, he was given re-employment on contract for one year or till the regular/direct Sub Divisional Engineer (Civil) joins in the department, whichever is earlier in public interest. Now, after order dated 06.11.2023, he has been orally told to join at Chandigarh, though no specific order to that effect has been conveyed. It is contrary to the terms of appointment since he was given re-employment at Sub-Division Dabwali.

In this situation, learned State counsel, appearing on advance notice, contends that the petitioner can make a representation to the department-respondent No.1, and his case for posting within the Provincial Sub-Division Dabwali or in the nearby District Sirsa, as far as possible, will be favourably considered.

Accordingly, the petition is disposed of in terms of statement made by learned State counsel granting liberty to the petitioner to file a representation before respondent No.1/Additional Chief Secretary to Government of Haryana, Public Works (B&R) Department, within a period of one week from today. In case any such representation is filed, the same shall be decided by respondent No.1 by passing a speaking order in accordance with law, within a period of two weeks from the date of receiving the representation.
