(ORAL) Prayer in the present petition filed under Section 482 Cr.P.C is for issuance of direction to respondents No.1 to 5 to place on record the status report in FIR No.459, dated 15.09.2017, Annexure P-10, registered under Section 174-A of the Indian Penal Code, 1860 at Police Station Faridabad N.I.T., District Faridabad.

At the very outset, learned counsel for the petitioner submits that as per the status report, the following stand has been taken by the State :- "4.

That thereafter a Red Corner Notice was issued by the Worthy Assistant Commissioner of Police (Crime) Faridabad. Copy of Notice is annexed herewith as Annexure-R/3. 5.

That thereafter a Final/Untraced report has been prepared by the Investigating Officer on 07-05-2018, which was sent to the Higher Authorities and after their recommendations the same was submitted before the Ld. Court of Shri Davender HIMANI GUPTA 2023.05.19 17:02 I attest to the accuracy and authenticity of this document/judgment High Court, Chandigarh

2023:PHHC:069821 CRM-M-60101-2022 -2Singh, JMIC, Faridabad which has been duly proved/accepted by the Ld. Trial Court vide order dated 05.05.2022. Copies of untraced report and the Zimni Order 05.05.2022 are annexed herewith as Annexure R- 4 and R-5 respectively. 6.

That since an untraced report in respect of the accused i.e. respondent No.6 has been submitted in the Trial Court, the present petition has become infructuous."

Learned counsel for the petitioner submits that in fact the accused/respondent No.6 (Vinod Kumar Sharma) is residing at the address as mentioned in the Memo of Parties of the present petition. Accordingly, learned counsel for the petitioner prays that he may be permitted to withdraw the present petition with liberty to file an appropriate application before the learned trial Court.

In view of the submission made by learned counsel for the petitioner, present petition is dismissed as withdrawn with the liberty aforesaid.
