He further made statement that the petitioner be allowed to withdraw the present petition with liberty to file application under Order 7 Rule 11 CPC seeking rejection of plaint, before the learned Trial Court. In light of the above, the present petition is hereby dismissed as withdrawn with aforesaid liberty.
