(ORAL) The petitioner has filed the present petition under Section 482 of the Code of Criminal Procedure, 1973 for quashing of FIR No. 2421 dated 19.12.2019 (Annexure P-8) under Section 174-A of the Indian Penal Code, 1860, Police Station Shivaji Nagar, Gurugram, District Gurugram, registered in pursuance to the order dated 20.08.2019 (Annexure P-7) passed by the trial Court in Complaint Case No. NACT/8731/2016 titled as 'Bhagwati Shuttering Store Vs. Mihir Buildcon Pvt. Ltd. and another' and all subsequent proceedings arising therefrom.
Learned counsel for the petitioner submits that the matter has been compromised between the parties and the above-said complaint had already been dismissed as withdrawn vide order dated 01.12.2022 (Annexure P-10) passed by the Judicial Magistrate Ist Class-cumPresiding Officer, Daily Lok Adalat, Gurugram and the petitioner has been acquitted. Thus, it is submitted that the main complaint had already been dismissed as withdrawn, the proceedings under Section 174-A IPC RISHU KATARIA 2023.01.06 17:07 I attest to the accuracy and authenticity of this order/judgment
CRM-M-60834-2022 -2may also be ordered to be quashed in the interest of justice.
