(Oral) At this stage, counsel for the respondent submits that he does not want to file reply and also, as per instructions of the respondent, has no objection if the transfer application is accepted and the petition under Section 13 of the Hindu Marriage Act is transferred from Ludhiana to Yamunanagar.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/804/2025, titled 'Parteek Gilhotra Vs. Surbi Gilhotra', filed by the respondent-husband, pending in the Family Court, Ludhiana and she seeks transfer of the same to the Court of competent jurisdiction at Yamunanagar. From the contents for the application, it is evident that one son born from the said wedlock on 05.01.2022, is in the care and custody of the PREETI 2026.05.12 09:03 I attest to the accuracy and integrity of this document

TA-1207-2025 applicant. On account of matrimonial dispute, the applicant has also filed petition under Section 125 of Cr.P.C. as well as petition under Section 12 read with Sections 18, 19, 20 and 22 of Protection of Women from Domestic Violence Act, which are pending in the Courts at Yamunanagar and the respondent is making appearance in both the said petitions. Besides the same, respondent has also filed guardian petition i.e. GW-51-2025, which is pending in the Courts at Yamunanagar. The applicant is having no source of earning. The distance between the two places is stated to be 160 kilometres. Considering the statement made by counsel for the respondent today and also the above-noted facts, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/804/2025, titled 'Parteek Gilhotra Vs.

Surbi Gilhotra', filed by the respondenthusband, stands transferred from the Family Court, Ludhiana, to the Court of competent jurisdiction at Yamunanagar. The requisite record of the aforesaid case be sent by the Family Court, Ludhiana, to the District and Sessions Judge, Yamunanagar.

Learned District and Sessions Judge, Yamunanagar, shall assign the said petition to the Family Court, Yamunanagar. Even, the parties are directed to appear before the Family Court, Yamunanagar, within a period of one month from today onwards.
