(Oral) CM-2161-CWP-2026 Prayer in this application filed under Section 151 CPC is for disposal of the main writ petition in view of the order dated 05.09.2024 passed by this Court in CWP-443-2024, titled as Bhagirath Ram and others vs Punjab State Civil Supplies Corporation Limited and others.

At the very outset, on joint request made by learned counsel for the parties, the main writ petition, which is listed for hearing on 28.07.2026, is taken up today for hearing.

Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to grant the petitioners the benefit of minimum of pay scale from the due date in terms of order dated 26.10.2016 (Annexure P-5) passed by the Hon'ble Supreme Court of India in Civil Appeal No. 213 of 2013 titled as State of Punjab & others Vs. Jagjit Singh & others along with all consequential benefits with interest @ 12% per annum as allowed to the petitioners in the CWP No. 4715 of 2012 titled as Gurmail Singh & others Vs. PUNSUP & other decided on 14.03.2012 (Annexure P-3), vide order dated 11.10.2012 (Annexure P-4) passed by the respondents, and also to consider the claim of the petitioners for regularization. 2.

Learned counsel for the applicants/petitioners submits that the case of the applicants/petitioners is squarely covered by the judgment rendered by this Court in Bhagirath Ram's case (supra) and the said writ petition i.e. Bhagirath Ram's case (supra) was decided along with CWP-25236-2023, titled as Darshan Singh and others vs State of Punjab and others and CWP-5279, titled as Raja Singh and others vs State of Punjab and others.

Learned counsel for the respondent/Corporation submits that the instant writ petition can be disposed of in terms of the judgment rendered by this Court in Darshan Singh's case (supra) and the claim of the petitioners would be examined in the light of the observations

made in Darshan Singh's case (supra) and appropriate order would be passed within a period of 03 months from the date of receipt of certified copy of this order.

In the wake of the statement made by learned counsel for respondent/Corporation and without expressing any opinion on the merits of the case, the present writ petition is disposed of with a direction to the respondents to examine the claim of the petitioners in the light of the judgments referred to hereinabove and pass a speaking order, in accordance with law.

Let the aforesaid exercise be carried out by the respondent/competent authority within a period of three months from the date of receipt of a certified copy of this order. 6.

In case the petitioners are found entitled to the benefit claimed, the consequential benefits be also released to them expeditiously in accordance with law.

Pending miscellaneous application, if any, also stands disposed of.
