**** ANOOP CHITKARA, J. (ORAL) The present petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No. 131 dated 23.11.2022 under Sections 21 of NDPS Act (Section 29 of NDPS Act added later on) registered at Police Station Badhni Kalan, District Moga.

Status report dated 20.01.2023 filed by State counsel today in the Court is taken on record.

In paragraph 9 of the petition, the petitioner has mentioned that he has involved in four more criminal cases and he has been acquitted in one case. However, State counsel on instructions submits that the petitioner was involved in seven more cases. Out of which, he has been acquitted in two cases. Even there is nothing mention in the police report qua FIR No. 261 of 2019 which was declared by the petitioner. It appears that the petitioner is presently involved in six cases. Given above, the present petition is misconceived and the same is dismissed. Liberty reserved to the petitioner to file a fresh petition. State to hand over the custody certificate to the counsel for the petitioner to enable him to file a fresh petition. All pending miscellaneous applications, if any, stand disposed of.
