Petitioner has filed the instant Petition under Section 439 of the Code of Criminal Procedure seeking grant of regular bail in case FIR No.77, dated 23.07.2022 under Section 22 and (Section 29 added later on) of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station Sandaur, District Malerkotla.

During the course of hearing, learned State counsel has handed over a copy of status report dated 22.01.2024 and custody certificate in Court today, which are taken on record, subject to all just exceptions. A copy of status report has already been supplied to learned counsel for the petitioner.

After arguing for some time, learned counsel for the petitioner submits that in light of the fact that the petitioner already stands convicted in case FIR No.100, dated 29.06.2019 under Sections 22 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station Sadar, Barnala, he may be permitted to withdraw the instant petition at this stage.

In view of the above, the instant petition is dismissed as withdrawn at this stage.
