Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing/setting-aside the impugned notice dated 02.02.2023 (Annexure P-3) to reduce the revised pension already granted on the basis of higher wages contribution than the ceiling limit w.e.f. January, 2023. Further prayer has been made to direct the respondents to disburse/release the already revised pension to the petitioners from the date it was discontinued without consequential benefits as already directed by this Court vide order dated 12.09.2024 passed in CWP No.10992 of 2023 and CWP No.12643 of 2023, wherein the impugned letters have been set-aside by allowing the benefits with a detailed order passed in CWP No.5378 of 2024, titled as Inderjit Singh Kaknian and others vs Union of India and others. Learned counsel for the petitioners submits that he would be satisfied if the representation dated 24.09.2024 (Annexure P-7) of the petitioners is decided by respondent No.3 by passing a speaking order in a time bound manner.

Learned counsel for respondents No.1 to 3, appearing on advance notice, submits that he has no objection, in case a direction is issued to the respondent No.3 for time-bound consideration and decision of the representation dated 24.09.2024 (Annexure P-7) of the petitioners by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioners, respondent No.3 is directed to consider the representation dated 24.09.2024 (Annexure P-7) of the petitioners and pass a speaking order in terms of the judgment passed in CWP No.5378 of 2024, titled as Inderjit Singh Kaknian and others vs Union of India and others, after affording an opportunity of hearing to the petitioners, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioners. Needless to say, if the petitioners are found entitled to the relief sought, the same shall be granted forthwith by respondent No.3. 5.

Disposed of, accordingly.
