(Oral) Prayer in the present petition filed under Section 439 of the Code of Criminal Procedure, 1973 is for grant of regular bail to the petitioner in case FIR No.56 dated 28.08.2019 under Sections 354D, 506, 509, 342/34 IPC and Section 12 POCSO Act registered at Police Station Women Police Station, Dabwali, Distrcit Sirsa. Counsel for the petitioner has argued that the allegations against the petitioner are of lesser magnitude as compared to other coaccused Chhinda @ Jajj, who has already been admitted on bail by this Court vide order dated 28.11.2019 passed in CRM-M-46414-2019 Chhinda @ Jajj Vs. State of Haryana.

Criminal Misc. No. M-52212 of 2019 -2Learned State counsel does not dispute the fact that similarly placed co-accused has been admitted on bail.

I have heard learned counsel for the parties. Considering the fact that the petitioner is in custody since 30.08.2019 and co-accused of the petitioner has already been admitted on bail vide order dated 28.11.2019, this Court deems it appropriate to release the petitioner on regular bail.

Accordingly, the present petition is allowed and the petitioner is admitted on regular bail, subject to furnishing of his bail bonds/surety bonds to the satisfaction of trial Court.
