Through the instant petition, as filed under Article 226 of the Constitution of India, the petitioners have sought issuance of directions upon the respondent No.2, to ensure protection of their lives and liberty at the hands of respondent No.3 and other police officials of Police Station Cantonment, District Police Commissionerate, Amritsar. 2.

The averments, as made in the petition for grant of relief (supra), are that the son of the petitioner No.1, namely, Gurwinder Singh Mann, has been arrayed as an accused in FIR No.191 dated 25.10.2023, under Sections 302, 307, 148, 149 of the IPC, and, Section 25/27 of the Arms Act, registered at P.S. Cantonment, District Police Commissionerate, Amritsar. The police officials have been harassing the petitioners on the pretext of knowing the whereabouts of the absconding son of the petitioner No.1.

The learned counsel for the petitioners has submitted that the petitioner had even moved a representation dated 13.11.2023 (Annexure DEVINDER YADAV 2023.11.17 20:47 I attest to the accuracy and authenticity of this order/judgment

CRWP-11120-2023 2023:PHHC:146126 P-2) to the respondent No.2, citing therein the instances of harassment being done to them. However, since the said representation has remained un-actioned, therefore, the petitioners have been constrained to access this Court for redressal of their grievance.

However, while traversing the record, as available before this Court, it has emerged that the representation (Annexure P-2) has been sent by the petitioners, through courier on 14.11.2023, while the instant petition has also been filed hastily on the very same date, i.e. 14.11.2023, without awaiting any response or outcome of the representation (supra). Therefore, the above conduct of the petitioners impels this Court to draw an inference that the petitioners, instead of permitting the officer/authority concerned to act upon their representation (supra), have straightaway approached this Court.

Consequently, the instant petition, being a premature motion, is dismissed and warrants no interference being made by this Court at this stage.
