(ORAL) Petitioner is seeking the concession of anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 in case FIR No.74 dated 21.09.2022 under Sections 406, 420 of the IPC and Section 13 of Punjab Travel Professionals (Regulations) Act, 2014 registered at Police Station City Balachaur.

Status report by way of affidavit of Deputy Superintendent of Police, Sub Division Balachaur, District Shaheed Bhagat Singh Nagar, has been filed in Court, which is taken on record. Copy supplied to the counsel opposite.

Learned State counsel at the outset has opposed the prayer made by the petitioner for extending the concession of anticipatory bail to him. It has been brought to the notice of this Court that there has been material concealment from this Court as it is a matter of record that on 09.11.2023, the petitioner had been declared a proclaimed person/absconder by the learned SDJM, Balachaur. 4.

In the facts and circumstances as enumerated hereinabove, no ground is made out to extend the extraordinary concession of anticipatory bail to the petitioner.

The instant petition stands dismissed.

However, it is made clear that anything observed hereinabove shall not be construed to be an expression of opinion on the merits of the case.
