(ORAL) This appeal is directed against an order dated 29.11.2022 passed by the learned Single Judge, whereby the claim of the petitioner (appellant herein) for extension of service for one year in terms of the instructions dated 31.05.2010 (Annexure P-1) issued by the Government of Haryana had been rejected on the ground that similar and identical issue which was directly and substantially in question in CWP-27222-2013 filed by the same petitioner had already been dismissed by the learned Single Judge on 11.12.2013 and, therefore, a second writ petition raking up the same issue after a long lapse of nine years could not be entertained.

The order passed by this Court in CWP-27222-2013 clearly states that the benefit of instructions, as claimed by the petitioner, cannot automatically be granted and can be granted only in exceptional cases and, therefore, the Court cannot issue any direction to the respondent-authorities to extend him the benefit of extension in service beyond retirement. The order dated 11.12.2013 passed by the learned Single Judge dismissing the earlier writ petition i.e. CWP-27222-2013 has attained finality. In the circumstances, we do not find any infirmity or illegality in the order dated 29.11.2022 passed by the learned Single Judge dismissing the second writ petition.

The appeal, accordingly, stands dismissed.
