(Oral) Instant petition has been filed under Section 439 Cr.PC for grant of regular bail to the petitioner in case FIR No.178 dated 08.09.2023 for the offences under Section 22 of NDPS Act, 1985 (Section 29 of NDPS Act added later on) registered at Police Station Guru Harsahai District Ferozepur.

Learned State counsel, at the outset, has opposed the prayer made by learned counsel for the petitioner for extending the concession of bail to the petitioner. Learned State counsel submits that the investigation in the case at hand is still under way and since the recovery effected from the petitioner is huge (1250 tablets of Etizolam), he does not deserve the concession of bail.

In the circumstances, keeping in view the stage of investigation, this Court would not be inclined to extend the concession of bail to the petitioner. Accordingly, the present petition stands dismissed. SONIA BURA 2024.02.07 18:06 I attest to the accuracy and integrity of this document
