$#% & # '() This appeal has been filed by the appellant being aggrieved by the order dated 22.11.2019 passed in Civil Writ Petition No. 34172 of 2019 dismissing the petition filed by him against the order dated 18.11.2019 whereby the appellant has been shifted to the post of Clerk, office of Sub Divisional Officer to the post of Clerk in the office of Sub Divisional Magistrate, Amritsar. Learned Single Bench has dismissed the petition stating that even in case the order impugned is in violation of any transfer policy that would not give any right to the petitioner to assail the same as transfer policy is not enforceable.
Learned counsel appearing for the appellant submits that the appellant has been replaced by another person who is not qualified to hold the post of Clerk in view of the fact that he has not passed the necessary departmental examination. Be that as it may having heard learned counsel for the appellant and taking note of the fact that the present case is not of transfer and is of mere shifting of the appellant from one part of the office to another. We do not find any reason to interfere with the impugned order passed by the learned Single Judge. The appeal is accordingly dismissed.
