The present revision petition has been filed under Article 227 of the Constitution of India challenging the order dated 20.08.2022 (Annexure P-1) whereby the application filed by the plaintiff-respondent Nos.1 to 3 under Order 6 Rule 17 of the Code of Civil Procedure, 1908 for amendment of the plaint has been allowed.

The only argument raised by the learned counsel for the defendant-petitioner is that the amended plaint filed by the plaintiffrespondent Nos.1 to 3 is not in consonance with the amendment application which has been allowed by the Trial Court vide the order dated 20.08.2022 and a totally different plaint has been filed. 3.

Per contra the learned counsel for respondent Nos.1 to 3, on instructions, states that the said amended plaint was inadvertently filed and the same was not signed and was returned by the Trial Court. CR-237-2023 (O&M) -2counsel undertakes to file a fresh amended plaint in consonance with the amendment application which has been allowed by the Trial Court vide the order dated 20.08.2022.

In view of the above, the present revision petition is disposed off with a direction that the plaintiff-respondent Nos.1 to 3 shall file a fresh amended plaint which shall be in consonance with the amendments which have been sought in the application and allowed by the Trial Court vide the order dated 20.08.2022.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
