PANKAJ JAIN, J. (ORAL) Apprehending his arrest in FIR No.46, dated 27.05.2021, registered for offences punishable under Sections 302, 326, 325, 324, 323, 427, 149 of the Indian Penal Code, 1860, at Police Station Saddar Rampura, District Bathinda, the petitioner has preferred this petition under Section 438 Cr.P.C. seeking pre-arrest bail.

Counsel for the petitioner submits that prior to approaching this Court the petitioner approached Sessions Court, Bathinda. This Court is shocked to see that vide order dated 31st of October, 2023 the application filed by the petitioner seeking pre-arrest bail has been dismissed for want of prosecution.

In the considered opinion of this Court dismissal of pre-arrest bail that too for want of prosecution is totally alien to the procedure in law. 4.

CRM-M-57828-2023 -22023:PHHC:146051 aside. The matter is remanded back. The Sessions Court is directed to decide the application filed by the petitioner seeking pre-arrest bail on 20th of November, 2023.
