The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.117 dated 15.11.2019 at Police Station Sadar Moga, District Moga under Sections 420, 379 and 447 of Indian Penal Code.

The allegations, in nutshell, are that the petitioner had removed 1000 bricks from a street.

Status report by way of affidavit of Sh. Paramjit Singh, PPS, Deputy Superintendent of Police (City), Moga has been filed by learned State counsel today in Court, which is taken on record, wherein it has been deposed that the petitioner has re-laid the bricks in the street in question and PANKAJ KAKKAR 2020.01.20 19:45 I attest to the accuracy and integrity of this document

( 2 ) CRM-M-52000-2019 (O&M) that during investigation at the spot, it had been found that the street had been duly paved.

The learned State counsel upon instruction from, ASI Angrez Singh, who is present in Court has informed that the petitioner has already joined investigation.

Having regard to the nature of offence and also that the petitioner has already joined investigation, custodial interrogation of the petitioner is not warranted.
