The present petition has been filed under Section 482 Cr.P.C. seeking direction to respondent Nos.2 & 3 to provide protection to the lives and liberty of the petitioners at the hands of private respondent Nos.4 to 7. It has been averred that the date of birth of petitioner No.1 is 01.01.1982 i,.e more than 37 years of age while date of birth of petitioner No.2 is 01.01.1986 i.e more than 33 years of age. Copies of Aadhar Cards of petitioner Nos.1 & 2 to this effect are attached as Annexures P-1 and P-2 respectively. It is averred that petitioners belong to muslim community. Both are already married. Petitioner No.1 was earlier married in the year 2001 with respondent No.7 and out of this wedlock, seven children were born whereas petitioner No.2 got married on 17.5.2009 and is having two male children from the marriage.
It is stated that after the marriage of petitioner No.1, her husband used to give her beatings. Fed up with her husband, petitioner No.1 left her matrimonial home on 28.11.2019 and came MANOJ KUMAR 2019.12.
CRWP No.1639 of 2019 #2# to petitioner No.2. Both of them have solemnized Nikah on 01.12.2019. The Nikahnama and photographs of marriage are attached as Annexure P-3 and P.4 (colly.). As private respondent Nos.4 to 7 are against the said Nikah, the petitioners apprehend danger to their live and liberty at the hands of the private respondents. The petitioners have submitted representation dated 01.12.2019 (Annexure P-5) to respondent No.2 in this regard. Without commenting upon the merits of the case or expressing any opinion on the merits of the case and the age of the petitioners, the present petition is disposed of with direction to respondent No.2 to look into the representation (P.5), in accordance with law.
