Present revision petition has been filed by defendant No.4 - Raj Rani (petitioner herein), challenging the order dated 20.05.2022 (P-5), passed by the Court of learned Civil Judge (Jr. Divn.), Gurdaspur, whereby, application filed by defendant No.4 (petitioner) under Order 7 Rule 11 of CPC, for rejection of the plaint, has been dismissed. 2.

On account of the fact that learned Trial Court has categorically observed that when no objection has been raised by defendants No.1 to 3, regarding non-issuance of notice under Section 80 CPC, it does not lie in the mouth of defendant No.4 (petitioner herein), who is a private party to seek rejection of plaint on this ground, counsel for the petitioner seeks withdrawal of present revision petition.
