******* SURINDER GUPTA, J.(Oral) Written statement on behalf of respondent No. 1 filed by learned State counsel today in the Court is taken on record. Learned counsel for respondent No. 2 submits that costs of `25,000/- has been deposited in the account of petitioner. Learned State counsel submits that election of Sarpanch has been conducted, encroachment by the respondent has been removed and as such, this petition has been rendered infrucutous. Learned counsel for the petitioner seeks permission to withdraw the petition with liberty to avail other legal remedies available to the petitioner.

Dismissed as withdrawn with liberty as prayed for. Rule discharged.
