VINOD S. BHARDWAJ, J. (Oral) Seeking quashing of the impugned Order dated 22.07.2022 passed by Learned Judicial Magistrate First Class, Barnala, along with all subsequent proceedings arising thereof in a case arising out of FIR bearing No. 516 dated 24.12.2019, under Section 61 of the Punjab Excise Act, 1914 registered at Police Station City Barnala, District Barnala, whereby the surety and bail bonds of the petitioner have been forfeited and Non-Bailable Warrants have been issued allegedly without due compliance of procedure as mentioned in Chapter VI of the Code of Criminal Procedure, 1973, the instant petition has been filed.

CRM-M-58003-2023 (O&M) -2Vide order dated 20.11.2023, passed by a Coordinate Bench of this Court, the petitioner was directed to surrender before the trial Court on or before 08.12.2023 and subject to his depositing Rs.10,000/- as costs with the Poor Patient Welfare Fund, PGIMER, Chandigarh, he was ordered to be admitted to interim bail to the satisfaction of the trial Court. No one has chosen to appear on behalf of the petitioner despite the matter having been called as many as three times during the day. Further, wait is not justified.

The present petition is disposed of at this juncture, with the following observations: - In the event the petitioner has deposited the costs and surrendered before the trial Court on or before 08.12.2023, in compliance to the order dated 20.11.2023, the said order be made absolute; and/or In the event, the petitioner having not appeared before the trial Court on or before 08.12.2023 and/or not having deposited the cost as imposed vide order dated 20.11.2023, the present petition be deemed to be dismissed.

Let, a copy of this order be sent to the trial Court. February 11, 2026.
