Prayer in the instant petition filed under Section 528 of the BNSS is for issuance of direction to respondents no. 2 and 3 to arrest accused/respondent no. 4 in FIR No. 189 dated 25.08.2024 under Sections 406, 420 IPC registered at Police Station Sadar Jalandhar. 2.

Learned counsel for the petitioner submits that the accused/respondent no. 4 has been declared a proclaimed offender in the abovesaid case . He has been threatening the petitioner to compromise the matter. The petitioner has also moved representation, Annexure P-6, to the authorities but no action has been taken so far. He prays that a direction be issued to respondents no. 2 and 3 to take action to arrest the accused/respondent no. 4 in the present case. Learned State counsel, who appears on advance notice, apprised the Court that in the present case, after dismissal of bail application of respondent no. 4 on 01.07.2024, he was declared a proclaimed offender on 27.08.2024 and a report under Section 173 Cr.P.C. stands filed and next date of hearing for evidene of police officials is 18.10.2025. So the petitioner has a remedy available to approach the competent Court. 4.
