As observed in the previous order, none had made appearance on behalf of the respondent. Even today, none has made appearance on behalf of the respondent. As such, the respondent is proceeded against exparte. Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA-196-2024, titled 'Balvir Singh Vs. Sonia Dadra', filed by the respondent-husband, pending in the Family (Camp) Court, Dasuya, District Hoshiarpur and she seeks transfer of the same to the Court of competent jurisdiction at Jalandhar.

At the very outset, counsel for the applicant submits that marriage between the parties to the lis had taken place on 25.10.2008, and three children were born from the said wedlock. TA-1192-2025 -2died. Now, one son and a daughter, who are in the age group of 10-12 years, are in the care and custody of the applicant. The applicant is not having any source of earning and is dependent upon her parental family. She has also filed petition under Section 125 Cr.P.C., which is pending in the Courts at Jalandhar and the respondent is making appearance in the same. The distance between the two places is stated to be about 60 kms.

In view of the submissions aforesaid, considering the fact of two children to be in the care and custody of the applicant, who herself, is not having any source of earning and is dependent upon her family and also considering the distance as well as the fact of other litigation, already pending in the Courts at Jalandhar and above it, considering the fact of respondent, not having come forward to resist the application, as such, the transfer application, as such, is hereby accepted and the petition under Section 9 of the Hindu Marriage Act i.e. HMA-196-2024, titled 'Balvir Singh Vs. Sonia Dadra', filed by the respondent-husband, stands transferred from the Family (Camp) Court, Dasuya, to the Court of competent jurisdiction at Jalandhar.

The requisite record of the aforesaid case be sent by the Family (Camp) Court, Dasuya, to the District and Sessions Judge, Jalandhar.

Learned District and Sessions Judge, Jalandhar, shall assign the said petition to the Family Court, Jalandhar. Even, the parties are directed to appear before the Family Court, Jalandhar, within a period of one month from today onwards.
