Petitioner vide this revision petition under Article 227 of the Constitution of India has assailed the order dated 25.08.2025 vide which the application under Order 9 Rule 13 of CPC has been dismissed. 2.

The appropriate remedy before the petitioner was filing appeal against the order in view of the provisions of Section 104 CPC and Order 43 Rule 1 of CPC. Since the petitioner has remedy of filing the appeal against the impugned order so this revision petition is dismissed with liberty to the petitioner to approach the competent Court.
