(ORAL) In the present case, the petitioner is impugning office order dated 27.06.2018 (Annexure P-8), having endorsement dated 03.07.2018, by which while giving the details of amount which the petitioner is entitled for after his retirement on 31.03.2017, an amount of `81,722/- has been kept for affecting recovery.
Counsel for the petitioner states that there is no justification with regard to withholding of amount of `81,722/- on any account for any recovery to be made as he was not ever charge-sheeted or he has not given any affidavit at the time of his retirement, giving powers to the respondents to make a recovery.
Counsel for the petitioner further states that against the letter dated 27.06.2018, the petitioner has already filed a representation with the NARESH KUMAR 2018.12.24 10:53 I attest to the accuracy and integrity of this document Chandigarh
CWP-33466-2018 -2respondents on 09.08.2018 (Annexure P-10) which is still pending consideration and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representation by passing a speaking order.
In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the claim made by the petitioner in the representation dated 09.08.2018 (Annexure P-10), by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months. Present writ petition stands disposed of.
