ANIL KSHETARPAL, J(Oral) A petition under Section 25 of the Guardians and Wards Act, 1890, read with Section 7 of the Hindu Minority and Guardianship Act, 1956, is pending before the Guardian Judge at Kurukshetra. The dispute is with regard to the custody of a child namely Aditya who is more than 13 years old. The petitioner herein is the father, whereas, the respondent is the mother of the child. The trial Court has refused to grant further opportunity to the petitioner to complete his evidence. On 24.09.2018 while issuing notice of motion, further proceedings before the trial Court were ordered to be deferred.
While deciding such matters, the Court is required to take into consideration the interest of the child. This is not an adversarial litigation. The petitioner wishes to examine his father who may be a relevant witness. Keeping in view the aforesaid facts, the petitioner is granted one last opportunity to lead his entire evidence. On the directions of the Court, the petitioner has already deposited Rs.15,000/- towards the litigation expenses. With these observations, the revision petition stands disposed of.
