The prayer in the present Civil Writ Petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, seeking setting aside of impugned result issued by official respondents dated 16.12.2022 (Annexure P-1) 2.

Learned counsel makes a reference to para No. 4 of the written statement dated 29.11.2023 filed on behalf of respondent No. 5, wherein it has been clarified that the subsequent revised results would relate back to original dates of declaration of results as per law of land, which is dated 02.09.2015 (Annexure R-5/4), which reads thus:

"4. In reply to Para 4 it is submitted that petitioner had passed Bachelor of Arts Third Year examination held in September2012 under Roll No./Pupin No. 13109000186 with 1564 marks out of 2400 marks and his result was declared on November 10, 2012, (ANNEXURE : R-5/1). His results of B.A. 2nd Year and 3rd Year (Additional Subject : Sociology) Exams held in April-2015 were declared as cancelled in main Result Gazette Notification dated 24.08.2015 (ANNE: R-5/3) and 02.09.2015 Gaurav Arora 2024.03.20 10:37 I attest to the accuracy and integrity of this document

CWP-30193-2022 2024:PHHC:038616 (ANNEXURE: R-5/4) respectively. The reason for cancellation is not available now as the old records are destroyed after two years. It appears on removal of query/objections his result of 2d Year Additional Subject : Sociology was declared vide Result Gazette Notification dated 14.09.2022 (ANNEXURE: R-5/5) and 3rd Year Additional Subject: Sociology was declared vide Result Gazette Notification dated 15.09.2022, ANNEXURE: R-5/6 and since original results were declared on 24.08.2015 (ANNEX R-5/3) and 02.09.2015 (ANNEXURE : R-5/4), the subsequent revised results would relate back to original dates of declaration of results as per law of land." 3.

He states that a representation dated 18.12.2022 (Annexure P-14) in this regard had already been submitted but is still pending, which may be directed to be decided in a time bound manner in view of the aforementioned stand of the respondent-University.

Learned State counsel has no objection to the limited prayer made. 5.

In view of the aforesaid and without commenting upon the merits of the case, this petition is hereby disposed of with a direction to respondents to consider and decide his representation, by taking into account the reply filed by respondent-University referred to hereinabove, within a period of three months and if found entitled, necessary benefit be granted to the petitioner forthwith.
