NIDHI GUPTA, J. (ORAL) Prayer in this petition filed under Section 482 Cr.P.C. is for quashing of FIR No. 0155 dated 14.11.2019 (Annexure P-1) registered under Sections 363 and 366-A IPC at Police Station Partap Nagar, District Yamuna Nagar and all subsequent proceedings arising therefrom.
Learned counsel for the petitioner, inter alia, submits that the petitioner has performed nikahnama with the daughter of respondent No. 2-complainant. They approached this Court seeking protection to their life and liberty by way of filing petition bearing CRM-M-344412019 which was disposed of vide order dated 26.11.2019 (Annexure P4). He further submits that now the couple is blessed with a child as well. Thus, it is submitted that the prosecution of the petitioner is nothing but an abuse of the process of law.
On instructions from SI Dal Singh, learned counsel for the State submits that in the present case, after completion of investigation, RISHU KATARIA 2023.09.04 18:07 I attest to the accuracy and authenticity of this order/judgment
CRM-M-52162-2019 -2- 2023:PHHC:114464 the police has prepared cancellation report on 17.08.2022 in favour of the petitioner and the same is pending consideration before the higher authorities.
Learned counsel for the petitioner does not dispute the aforesaid fact.
