This is an application filed under Section 5 of Limitation Act, 1963 read with Section 151 CPC for condonation of delay of 99 days in filing the present appeal.

For the reasons stated in the application, the same is allowed and the delay of 99 days in filing the present appeal is condoned. FAO-360-2020 1.

Injured has filed the present appeal for enhancement of compensation. The Tribunal vide award dated 29.05.2019 had granted NARESH KUMAR 2026.05.27 18:37 I attest to the accuracy and integrity of this document/judgement

FAO-360-2020 (O&M) -2compensation to the tune of Rs.1,60,000/- along with interest on account of injuries suffered by the injured in a motor vehicular accident. 2.

During the course of arguments, a very fair stand has been taken on behalf of the appellant as well as respondent No.3-insurance company and it has been jointly submitted that the appellant is entitled to an additional compensation of Rs.60,000/- as full and final settlement including interest.

Keeping in view the above-said facts and circumstances, the present appeal is partly allowed and the award dated 29.05.2019 qua MACT Case No.33 of 2018 filed by the injured-Ajit is modified to the extent that the appellant is entitled to additional compensation of Rs.60,000/- and respondent No.3-insurance company is directed to pay the said additional amount of Rs.60,000/- to the appellant within a period of one month from today, as full and final settlement.
