The instant petition under Section 528 of BNSS has been filed by the petitioner for quashing of FIR No. 19 dated 20.02.2014, under Sections 379, 411 and 489 IPC, Police Station Khanauri, District Sangrur, and order dated 31.10.2022 (Annexure P2), passed by the learned Judicial Magistrate 1st Class, Moonak, whereby the petitioner was declared Proclaimed Offender. All the subsequent proceedings have also been sought to be quashed.

Since advance notice has already been served upon the State, Mr. Eklavya Darshi, Deputy Advocate General, Punjab, accepts notice on behalf of the respondent and waives service.

It has been contended by learned counsel for the petitioner that DEEPAK KUMAR BHARDWAJ 2025.09.19 16:02 I attest to the accuracy and integrity of this document this petition be disposed of with a direction to the learned trial Court to

Criminal Misc. No. M- 52868 of 2025 dispose of the application for surrender and bail moved by the petitioner, within a stipulated time frame.

In view of above, the present petition is disposed of with a direction to the petitioner to surrender before the learned trial Court. If he surrenders before the learned trial Court and moves an application for bail, the learned trial Court shall dispose of the same within a period of three working days, thereafter. It is, however, clarified that the learned trial Court, in the exercise of its discretion, shall be at liberty to take the petitioner in judicial custody or impose penalty under Section 491 of BNSS (erstwhile Section 446 of CrPC).
