The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue her passport.

Learned counsel for the petitioner inter alia contends that mother of the petitioner has solemnized second married and petitioner has applied for passport with name of step father in the column of particulars of father. The respondent has formed an opinion that passport can be issued only with name of biological father. This Court in Mohit vs. Union of India 2017(1) RCR(Civil) 1003 has held that passport can be issued with step father's name.

Faced with this, learned counsel for Union of India submits that petitioner may be directed to appear before passport authority alongwith her PARAMJIT KAUR SAINI 2023.11.29 17:27 I attest to the accuracy and authenticity of this order/judgment
CWP No.26068 of 2023 -2- 2023:PHHC:151319 parents and requisite documents. On doing so, passport authority, considering the aforesaid judgment, would pass an appropriate order within six weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.
