IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-58544-2023 Date of Decision : November 20, 2023 MANINDERPAL KAUR AND OTHERS -Petitioners V/S STATE OF PUNJAB AND OTHERS -Respondents
CORAM:
HON'BLE MR. JUSTICE KULDEEP TIWARI
Present:
Mr. R.S. Sekhon, Advocate for Mr. I.S. Dhaliwal, Advocate for the petitioners.
*** KULDEEP TIWARI, J. (ORAL) 1.
Through the instant petition, as instituted under Section 482 of the Cr.P.C., a prayer is made for issuance of directions upon respondents No.2 and 3 for conducting investigation upon representation dated 28.08.2023 (Annexure P-1) in a fair and proper manner. 2.
The learned counsel appearing for the petitioners does not dispute the factum that no FIR has yet been registered. Therefore, in such circumstances, there does not arise any occasion for the official(s)/officer(s) concerned to conduct and a fair and proper investigation. 3.
Faced with the above situation, the learned counsel for the petitioners seeks leave to withdraw the instant writ petition, however, with liberty to approach the appropriate authority/court concerned for redressal of his grievance.
4.
Leave granted.
5.
Consequently, the instant writ petition is dismissed as withdrawn, however, with liberty (supra).
